IJCIMBI 2015 – Research Paper: Formulating Standard Form of Construction Contract in Indonesian Context

Konferensi kedua yang saya ikuti adalah International Joint Conference of Indonesia Malaysia Bangladesh and Ireland 2015 yang diadakan di Aceh, Indonesia pada 27-28 April 2015. Kali ini paper saya yang dipresentasikan berjudul Formulating Standard Form of Construction Contract in Indonesian Context. Berikut adalah abstraknya.

Abstract

Construction contract can be defined as a legally binding agreement between one party to another in doing construction business. It serves as the foundation in executing a construction project. If made and managed properly, it will minimize the appearance of potential disputes in construction projects. Indonesia as the second largest construction market in Asia needs a standard form of construction contract in order to give the same understanding towards some principles, definitions and interpretations of contract clauses. However there is no single common standard form of construction contract produced by an entity which will greatly boost the dynamic of this industry. Therefore, this applied research has objectives: (1) to identify the benefits of standard form of construction contracts, (2) to identify the challenges in adopting standard form of construction contracts in Indonesia, and (3) to propose a model of standard form of construction contract which in line with Indonesia construction industry requirements. The research method used for this report was a comprehensive review of the literature over the past 10 years. From the analysis we can derived the answers for each questions and generates a standard form of construction contract which has been modified to meet the Indonesian context.

Keywords: construction contract, standard form, benefits of standard form, Indonesian context.

ICCEE 2015 – Research Paper: Study on the Management of EPC Projects

Pada 3-5 Februari 2015 diadakan sebuah konferensi internasional berjudul International Conference on Civil Engineering and Environmental Engineering (ICCEE) 2015 di Tokyo, Jepang. Penyelenggara konferensi ini adalah Asia-Pacific Education & Research Association (AERA). Tulisan saya yang berjudul Study on the Management of EPC Projects diterima sebagai salah satu paper yang dipresentasikan disana. Berikut adalah abstraknya.

ABSTRACT
Procurement system in construction industry can be categorized into several methods. One of them is EPC type of procurement. EPC is the abbreviation for engineering, procurement and construction. EPC is a type of construction contract where the contractor is responsible for engineering services, procurement of materials, and construction. Power plants, factories, gas development project, infrastructure projects, and industrial plant construction sectors are the typical examples of EPC projects. With its rapid development, Indonesia needs many industrial public sector projects. Especially with the population over 230 million people and blessed with so many natural resources, the demand for power plant projects, gas development projects, and other types of industrial sector projects has risen significantly. Meanwhile, PT Waskita Karya (Persero) Tbk is one of the main leading construction service companies in Indonesia and it just recently won the Most Expansive Construction Company Award in 2014 for Building Construction Company 2014 from Economic Review Magazine. Waskita has several divisions ie. building, infrastructure, EPC, precast, and realty. EPC division is one of the new established division inside the company. This research is conducted with a case study on PT Waskita Karya (Persero) Tbk. Therefore, this research aims to (1) identify the nature of EPC projects, (2) identify EPC projects management system as applied in Waskita, and (3) determine the strategies which can improve the effectiveness of EPC business process. The findings of this research are (1) there are 34 (thirty four) EPC projects’ characteristics, in which 10 (ten) of them are specifically only found in EPC projects; (2) EPC projects in Waskita are quite different in their implementation where for some projects, EPC division serves only engineering and procurement phases; and (3) the improvement strategies can be divided into 3 (three) groups, namely: for contractor with 15 strategies, for employer with 5 strategies, and for both parties with 6 strategies. At the end, these findings served as a preparation for all players to face the increase popularity of EPC project procurement.
